These Terms of Service (“Terms”) govern your use of the Balancer Android application and the website at balancerlife.app (together, the “Services”). By downloading, installing, or using Balancer, you agree to these Terms.
1. The Services
Balancer is a personal wellness and life-balance tracking tool. It helps you log activities across life areas, set goals, and view a Balance Score and related insights on your device. Balancer is not a medical device, clinical service, therapy product, financial product, or professional advice service.
2. Eligibility
You must be able to form a binding agreement under the laws of your region. If you are under the age of digital consent where you live, you may only use Balancer with involvement of a parent or guardian as required by local law.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Balancer on devices you own or control, for your own personal, non-commercial use, subject to these Terms and Google Play’s terms.
You may not:
- Copy, modify, distribute, sell, or lease any part of the Services except as allowed by law
- Reverse engineer the app except where such restriction is prohibited by law
- Misrepresent the app’s purpose, scrape the website abusively, or attempt to disrupt the Services
- Use Balancer to violate applicable law
4. Your content and data
You retain ownership of the information you enter into Balancer. You are responsible for the accuracy of what you log and for safeguarding backups you export. Because Balancer stores data on-device by default, losing a device or uninstalling without a backup may result in permanent loss of that local data.
5. No medical or professional advice
Scores, labels, insights, reminders, and summaries are informational tools only. They are not diagnoses, treatment plans, or guarantees of health outcomes. Always seek qualified professional advice for medical, mental-health, or other specialist needs.
6. Website
The website provides product information, legal pages, and support contact details. Content may change without notice. Play Store availability depends on Google’s policies and your region.
7. Third-party services
Google Play, Android system features (notifications, biometrics), and device manufacturers provide infrastructure outside our control. Their terms and privacy policies apply to those components.
8. Disclaimer of warranties
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that scores will match your subjective sense of balance.
9. Limitation of liability
To the fullest extent permitted by law, Balancer and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the app in the 12 months before the claim, or (b) USD $25. Some regions do not allow certain limitations; in those regions, our liability is limited to the maximum extent permitted.
10. Termination
You may stop using Balancer at any time by uninstalling it. We may stop distributing updates or withdraw the app from stores if required by law, platform policy, or product decisions. Provisions that should survive termination (including disclaimers and limitations) will continue to apply.
11. Changes to these Terms
We may update these Terms. The effective date will change when we do. If you continue using the Services after an update, you accept the revised Terms. If you do not agree, stop using the Services and uninstall the app.
12. Governing law
These Terms are governed by the laws applicable in your place of residence where mandatory consumer protections require that outcome; otherwise they are interpreted under general principles of fairness and applicable platform rules. Nothing in these Terms limits non-waivable consumer rights.
